Content & Image Policy

This Content & Image Policy ("Policy") supplements our Terms of Service and forms an integral part of your agreement with NAUNIHAL SON'S VENTURES TECHNOLOGIES PRIVATE LIMITED ("Company", "we", "us"), operator of outfitfashion.co.in ("Platform"). It explains the sources of imagery and content on the Platform and how we handle requests, complaints and removal.
1. Sources of Imagery on the Platform
Visual content on the Platform may include any combination of the following:
- In-house photography commissioned by the Company.
- Brand & vendor catalogue images provided by the manufacturer or licensed supplier.
- Influencer, model and creator collaborations shared with the Company under licence or paid engagement.
- Social-media content (e.g. Instagram, YouTube) used with permission, attribution, or under applicable fair-use principles.
- Stock photography licensed from third-party providers.
- AI-generated or AI-assisted imagery created or enhanced using artificial-intelligence tools, used to illustrate styling, fit, mood, or background.
Where required by applicable law (including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 as amended in February 2026), AI-generated or synthetically altered imagery will carry a visible label or equivalent disclosure on the Platform.
2. Intellectual Property
All content on the Platform — including text, photographs, illustrations, AI-generated visuals, layouts, and trademarks — is the property of the Company or its licensors and is protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international laws. No reproduction, distribution, scraping, or commercial exploitation is permitted without our prior written consent. Brand and vendor names referenced on the Platform are nominative fair use for product identification only.
3. Notice & Takedown — Our Trust Commitment
If you are a copyright owner, trademark holder, photographer, model, influencer, or any other person who believes that any image or content on the Platform infringes your rights or has been used without your consent, please raise a request to our Grievance Officer. We respect every legitimate request and will act in good faith.

Please include: (a) your full name and contact details; (b) identification of the original work; (c) the exact URL(s) of the disputed content on the Platform; (d) a good-faith statement that the use is unauthorised; and (e) a signed declaration that the information is true.
In line with the IT Rules 2021 (as amended), we will action valid requests within the following indicative timelines on receipt of a complete and verifiable notice:
- Non-consensual intimate imagery: within 2 hours.
- Synthetic / AI-generated content covered by a valid government or court order: within 3 hours.
- General copyright, trademark, likeness or impersonation complaints: within 36 hours.
Removal of disputed content does not constitute an admission of liability. We may, at our sole discretion, restore content on receipt of a valid counter-notice from the original uploader together with adequate proof of right.
4. Influencer & Creator Collaborations
Content shared with the Company under collaboration, sponsorship, gifting, or licence remains governed by the underlying agreement. Creators retain ownership of their original work unless expressly assigned. Either party may request removal or modification of jointly produced content with reasonable notice; the Company will honour such requests where the request is bona fide and not made to circumvent contractual obligations.
5. AI-Generated Content — Use, Limits, and Disclaimers
The Company may use generative-AI tools to create illustrative imagery, model overlays, fit visualisations, lifestyle backgrounds, or descriptive text. Such use is intended to enhance the shopping experience and is not represented as a photograph of any specific real person, location, or event unless expressly stated. The Company:
- does not knowingly generate content depicting any real, identifiable individual without consent;
- will not use AI to misrepresent product characteristics or to impersonate any person;
- will label AI-generated visuals where required by applicable law;
- will remove or modify AI content on a bona-fide complaint received under Section 3 above.
6. User-Submitted Content
If you upload reviews, photographs, ratings, comments, or any content to the Platform ("User Content"), you confirm that you own or have the necessary rights in it and grant the Company a worldwide, royalty-free, perpetual, non-exclusive licence to use, host, display, reproduce, and adapt such content for the operation and promotion of the Platform. You are solely responsible for User Content and indemnify the Company against any claim arising from it.
7. "As Is" Basis & Limitation of Liability
All imagery and content is provided on an "as is" and "as available" basis. Colours, sizing, textures, model appearance and styling reproduced through any photograph, AI rendering, or screen may differ slightly from the actual product. To the maximum extent permitted by law:
- The Company makes no warranty, express or implied, regarding the accuracy, completeness, or non-infringement of any third-party content displayed on the Platform.
- The Company shall not be liable for indirect, incidental, special, exemplary, or consequential damages arising out of or relating to imagery or content on the Platform.
- The Company's aggregate liability for any claim relating to imagery or content shall not exceed the value of the order in connection with which the claim is raised, or INR 5,000, whichever is lower.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, affiliates, vendors and licensors from and against all claims, demands, damages, costs, and legal expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your User Content; (ii) your breach of this Policy or our Terms of Service; (iii) your violation of any third-party right, including intellectual-property, privacy, or publicity rights.
9. Intermediary Status & Safe Harbour
The Company acts as an intermediary in respect of third-party content (including vendor catalogue images and User Content) within the meaning of Section 79 of the Information Technology Act, 2000. The Company is not the originator of such content and disclaims all liability that arises from third-party content, save and except where mandated under applicable law.
10. Repeat Infringers & Frivolous Claims
The Company maintains a zero-tolerance policy for repeat copyright or trademark infringers and reserves the right to terminate accounts or block access. Equally, the Company reserves the right to refuse, archive, or seek costs in respect of vexatious, frivolous, or knowingly false takedown notices. Submitting a false notice may attract penalties under Section 199 of the Bharatiya Nyaya Sanhita, 2023, and Section 52(1)(c) of the Copyright Act, 1957.
11. Severability & Force Majeure
If any provision of this Policy is found unenforceable, the remaining provisions shall continue in full force. The Company shall not be liable for any failure or delay in removal, response, or service caused by events beyond its reasonable control, including but not limited to internet outages, registry failures, court orders, or government action.
12. Governing Law & Exclusive Jurisdiction
This Policy is governed by and construed in accordance with the laws of India.
EXCLUSIVE JURISDICTION: Any legal dispute, controversy or claim arising out of or relating to this Policy, the Platform, or any content displayed on the Platform shall be subject to the EXCLUSIVE jurisdiction of the courts at Mathura, Uttar Pradesh, India, to the exclusion of all other courts. By using the Platform, you irrevocably submit to such jurisdiction and waive any objection to venue.
13. Changes to this Policy
We may update this Policy from time to time to reflect changes in law, technology, or our operations. The "Last Updated" date above will reflect any such revision, and continued use of the Platform constitutes acceptance of the updated Policy.
